PRIVACY STATEMENT FOUNDATION A WARM HEART

This privacy statement describes how A Warm Heart Foundation, based at Elektroweg 11Z 3051 NB Rotterdam, Netherlands with Chamber of Commerce number 90502027, (hereinafter "we", "our" or "the Foundation"), collects, uses, and protects personal information provided by our donors. We value the privacy of our donors and take all necessary measures to protect and respect personal information in accordance with applicable data protection legislation, in particular the General Data Protection Regulation (GDPR).

Collection of personal information

We collect personal information from donors in the following ways:

  • Donor Registration: When donating to our foundation, we ask for personal information such as your name, email address and payment details.  
  • Communication: When you contact us via email, phone, or other means of communication, we ask for personal information such as your name, phone number and your email address. 
  • Information: When you sign up to be notified of our news, we ask for personal information such as your e-mail address. 
  • Helping Hands: When you have signed up to get involved in one of our initiatives, we ask for your personal information such as your name, phone number and your email address.

We are responsible for the personal information we receive from you. We treat the information we receive with confidentiality and care, which means we will delete the personal information when it is no longer needed. 

Use of personal information

We use personal information for the following purposes:

  • Donation management: Processing donations, maintaining donation history, and providing donation confirmations. 
  • Communications: Providing updates, newsletters and information about our activities, events, and campaigns you may be interested in. Also for the purpose of responding to questions and/or comments and/or disputes. 
  • Helping Hands: Maintaining contact with you about this and to answer all your questions. 
  • Complying with legal obligations: Complying with legal financial and tax obligations, reporting requirements, including the AVG.

We use personal information because you have consented to it and because there is a reason for it; you support the Foundation's initiatives. You can unsubscribe from communications or change and/or end your regular donation at any time. You can do this by filling in the change or termination form on our website or by sending an e-mail to contact@awarmheartfoundation.org

Sharing of personal information

We share donors' personal information only in the following situations:

  • With third parties providing services on behalf of the foundation, such as payment processors, but only to the extent necessary to provide the requested services. These third parties are contractually obliged to protect donors' personal information and comply with the AVG.
  • With government bodies or law enforcement agencies when required by law, in accordance with the AVG. 

Your data will remain with the Foundation and will neither be used nor shared for purposes other than those mentioned above. 

Security of personal information

We take appropriate technical and organizational measures to protect personal information from unauthorized access, use, disclosure, or destruction, in accordance with the requirements of the AVG. You always have the option to complain about the Foundation's use of your personal information. We request that you first do so with us at contact@awarmheartfoundation.org However, if you are not satisfied with our response, you can contact the Personal Data Authority: https://autoriteitpersoonsgegevens.nl This is a Dutch independent regulator. 

Your rights under the AVG

Under the AVG, donors have certain rights in relation to their personal information, including:

  • The right to access their personal data.
  • The right to correct incorrect personal data.
  • The right to erasure of personal data (the "right to be forgotten").
  • The right to object to the processing of personal data.
  • The right to data portability, if applicable.

Donors can exercise these rights by contacting us at contact@awarmheartfoundation.org  We will take all reasonable steps to comply with these requests as required by the AVG.

Data breach

In accordance with the AVG, we have procedures for dealing with data breaches. If there is a data breach that poses a risk to the rights and freedoms of donors, we will immediately notify the Personal Data Authority and, if applicable, the data subject(s).
